Terms of Service

2. Scope of Services

Postieri XYZ provides digital systems and technology engineering services, including:

• Website as a Service (WaaS): Managed web platforms, hosting infrastructure, domain provisioning, and recurring updates.
• Hermes AI Agent Hosting (HaaS): Dedicated agent container hosting, workflow bots, and gateway integrations.
• Custom Software & Mobile Applications: Next.js web applications, React Native mobile apps, and database engineering.
• CRM & Digitization Consulting: Business automation, Perfex CRM deployments, and ATK-compliant invoicing integrations.

Subscriptions, Cancellation & Service Levels

• Term: Monthly subscriptions renew each month; annual subscriptions renew each year unless cancelled.
• Cancellation: Monthly plans may be cancelled with 30 days' written notice (email or WhatsApp). Annual plans are not refunded for the unused part of a paid year and simply are not renewed.
• Exit & data: On cancellation we transfer domains registered in the client's name and provide an export of the client's content and data. Hosting ends at the end of the paid period.
• Availability: We monitor all managed services around the clock and restore them as quickly as practicable. Any specific uptime percentage or response time applies only where it is written into the client's Statement of Work (SOW).
• Included changes: Routine content updates are included in WaaS plans. New pages, features or integrations beyond the purchased package are quoted in writing before work begins.

3. Billing & Invoicing

Subscription services (WaaS and HaaS) are billed on an annual or monthly recurring basis as agreed in the applicable Statement of Work (SOW). Official invoices are issued in compliance with Kosovo Tax Administration (ATK) legal requirements.

4. Intellectual Property

Upon full settlement of agreed contract fees, bespoke design deliverables, content, and proprietary client business data are owned exclusively by the client. Pre-existing frameworks, harnesses, and scaffolding tools remain the property of Postieri XYZ L.L.C.

5. Governing Law

These Terms are governed by and construed in accordance with the substantive laws of the Republic of Kosovo. Any disputes shall be subject to the jurisdiction of the competent court in Gjakovë, Kosovo.
